To state a cause of action for incapacity discrimination, an employee must be disabled, thought of as disabled, or have a record of being disabled. The employee must then show that:

one) his or her disability ends up in physical limitations 2) that he can still perform the essential functions of the job (with or without reasonable accommodations) 3) and therefore the employer took some adverse action (like not hiring, firing, or demoting the employee) on the principle of that disability.
